Terms of use

The agreement between you and us when you use Prospekt. In short: your leads are yours, use Prospekt lawfully, and we look after it and your data.

This agreement

These terms are an agreement between you and MYNEXTADDRESS, a sole proprietorship (Udyam registration UDYAM-KR-03-0739672) (“we”, “us”), the business behind Prospekt: prospekt.co.in, app.prospekt.co.in, crm.prospekt.co.in, the Prospekt Android app and the Prospekt API.

By creating an account, being added to one, or using Prospekt, you accept these terms and our Privacy policy. If you use Prospekt for a company, you confirm you're allowed to accept them on its behalf.

If your company has a separate signed agreement with us (for example, for our marketing services), that agreement comes first where the two differ.

Accounts

  • Prospekt is for businesses and the people who work for them. You must be at least 18.
  • A company's admins decide who is on its team and what each person can see, and are responsible for keeping that list up to date, including removing people who leave.
  • Keep your sign-in details, codes and API keys to yourself. Tell us at support@prospekt.co.in straight away if you think someone else has used your account.
  • You're responsible for what happens in your account, and your company for what happens in its account.

Your data

  • Your leads are yours. Everything your company puts into Prospekt (leads, remarks, call logs, settings) belongs to your company. You can export it to Excel at any time.
  • You give us permission to store and process that data only to provide Prospekt to you: delivering, organising and reporting on your leads, and supporting you. We don't sell it or use it for anyone else.
  • You're responsible for having collected your leads lawfully: telling people how their details will be used (for example, in the privacy notice on your ad forms and website), getting any consent the law needs, and honouring their requests. That includes India's Digital Personal Data Protection Act, 2023.
  • When you contact leads, follow the rules on calls and messages, including TRAI's rules on unsolicited commercial communication and the policies of WhatsApp, Meta and Google.

Acceptable use

Don't use Prospekt to:

  • store or send anything unlawful, or personal data you have no right to hold;
  • send spam, or contact people who have asked not to be contacted;
  • try to get into other companies' data, other accounts, or parts of Prospekt you haven't been given;
  • copy, resell, or reverse-engineer Prospekt, or scrape it;
  • overload it, attack it, or upload anything harmful, such as malware;
  • share API keys outside your company, or use the API beyond its published limits.

If an account is being used in a way that harms others or breaks the law, we may pause it; we'll tell you why unless the law doesn't let us.

Connected services

Prospekt can connect to other services, such as Facebook and Instagram (Meta), Google Ads, Google Sheets and WhatsApp. When you connect one, you also follow that service's own terms, and it's that service that decides what it makes available. We're not responsible for their outages or changes, but we'll do our best to keep your connections working and tell you when something needs your attention.

Fees

  • Fees are as shown on your plan, order or invoice. Prices are in Indian rupees and exclude GST, which is added as the law requires.
  • If fees are more than 15 days overdue, we may pause the account after telling you. Your data isn't deleted while an account is paused.
  • Where our marketing services come with Prospekt, the fees and terms for those services are in your separate agreement with us.

The service

  • We work to keep Prospekt available and fast, and to fix problems quickly, but we can't promise it will never be interrupted, for example during maintenance or an outage at a provider we rely on.
  • We improve Prospekt all the time. If we remove something important you rely on, we'll tell you in advance.

Ending your account

  • You can stop using Prospekt at any time. To close your company's account, write to support@prospekt.co.in.
  • We may close an account for a serious or repeated breach of these terms, or unpaid fees, after telling you and giving you a chance to fix it where that's reasonable.
  • Before an account is closed, you can export your leads. After closure, data is deleted as set out in our Privacy policy.

Our property

Prospekt itself (the software, design, and the Prospekt name and logo) belongs to us. These terms give you the right to use it while your account is active; they don't give you ownership of it. If you send us ideas or feedback, we may use them to improve Prospekt, with no obligation to you.

Liability

  • Prospekt is provided as it is. As far as the law allows, we don't give promises beyond those in these terms.
  • We're not responsible for indirect losses, such as lost business, lost profits or missed sales opportunities.
  • As far as the law allows, our total responsibility for any claim is limited to the fees you paid us for Prospekt in the 12 months before the claim.
  • You'll cover us for claims that arise because your company collected or used leads unlawfully, or broke these terms.

Nothing here limits responsibility that the law doesn't allow to be limited.

Law and disputes

These terms are governed by the laws of India. If a dispute arises, we'll first try to settle it by talking; if that doesn't work, the courts in Bengaluru, Karnataka have jurisdiction.

Changes to these terms

We may update these terms. If a change matters, we'll tell you in Prospekt or by email at least 15 days before it takes effect. Continuing to use Prospekt after that means you accept the new terms.
